This paper investigates the adequacy of evidential relevance relations proposed by Glymour and others. These accounts incorporate, as a necessary condition, what I call the Positive Instance Condition (PIC): the evidence statement and auxiliary assumptions entail a "positive instance" of the hypothesis. I argue that any account which incorporates PIC as a necessary condition while allowing "bootstrap testing" is doomed to fail. A nonbootstrapping evidential relevance relation of similar form is proposed, and it is argued that, in addition to avoiding (...) published counter examples, this new relation meets two general requirements which, if not met, would undermine the ability of any account that incorporates PIC to accord with our intuitions of evidential relevance. Human behavior is guided by evolutionarily shaped brain mechanisms that make statistical predictions based on limited information. Such mechanisms are important for facilitating interpersonal relationships, avoiding dangers, and seizing opportunities in social interaction. We thus suggest that it is essential for analyses of prejudice and prejudice reduction to take the predictive accuracy and adaptivity of the studied prejudices into account.

The charge to the speakers was less to reflect on the situation of French studies in the American academy than to offer possibilities for the future, whether through programmatic argument or (...) illustration of the sort of work that might be undertaken under the banner of French studies. The editors have substituted for two papers from the conference that were already committed elsewhere two new papers from colleagues engaged in French studies at Cornell.The ongoing arguments about the future of French studies seem riven by a conflict of motives and aims. There are those who wish to confirm the dissolution of any fetishized notion of Frenchness, insisting on the multiplicity of francophonies and the fragmenting effects of globalization on anything that claims to be a specifically French identity. Conversely, there are those who promote French studies precisely as the defense of an irreducible specificity of things French, which is threatened by changes in the university and in the world and which the new field of French studies might have a chance of preserving. If these are not the options that our contributors embrace, it is not because they are insensible of their attractions—or of the beguiling possibility of combining them, by defining that essential Frenchness, to be pursued or preserved, as the dissolution of the idea of an essential Frenchness.One of the general aims of these papers is to promote and illustrate possibilities for novel kinds of reading and writing and for inventive modes of interdisciplinary study, which make French studies a lively field for students and teachers. But if there is a single substantial theme that runs through them all, it may be the mundane concern that Tom Conley calls “wondering what can be done to invigorate one of the richest of all literary canons.” How does that canon respond to the kinds of questions and issues that the unraveling and dissolution of boundaries—including those of France itself—have made possible? John Broome’s Climate Matters is a timely, elegant, and accessible book. His book is deliberately interdisciplinary, as is much of his work in moral philosophy more generally. Scholars loosely affiliated with the "Cambridge School" (e.g., Pocock, Skinner, Viroli, and Pettit) accentuate rule of law, common good, class equilibrium, and non-domination in Machiavelli's political thought and republicanism generally but underestimate the Florentine's preference for class conflict and ignore his insistence on elite accountability. The author argues that they obscure the extent to which Machiavelli is an anti-elitist critic of the republican tradition, which they fail to disclose was predominantly oligarchic. The prescriptive lessons these scholars draw from republicanism for (...) contemporary politics reinforce rather than reform the "senatorial," electorally based, and socioeconomically agnostic republican model (devised by Machiavelli's aristocratic interlocutor, Guicciardini, and refined by Montesquieu and Madison) that permits common citizens to acclaim but not determine government policies. Cambridge School textual interpretations and practical proposals have little connection with Machiavelli's "tribunate," class-specific model of popular government elaborated in The Discourses, one that relies on extra-electoral accountability techniques and embraces deliberative popular assemblies. Neither the historical tradition of American constitutionalism nor those who have theorized about it have promoted political or theoretical designs hospitable to the valorization or promotion of democratic virtue. This article illustrates this point by canvassing practical interpretations of the American constitution, from the document of 1787–1791 to Bush v. Gore, and theoretical interpretations from Madison to Rawls, Dworkin, Ackerman, Elster, Holmes, and other contemporary theorists of liberal constitutionalism and natural law. Exposing these roadblocks to the theory and practice (...) of democratic virtue in America, it argues, provides a critical corrective to current debates about the relationship between constitutionalism and democracy. The individual contributions fall into four broad categories, with fruitful overlaps between them. These are: (1) Hume’s biography and his immediate Scottish context; (2) the philosophical framework of Hume’s economic thinking provided by his account of human nature; (3) Hume’s treatment of money; and (4) the reception of Hume’s economic writings in France, as a starting-point for exploring his contribution to the wider European Enlightenment debate over the prospects of the modern commercial economy.Two established scholars of the Scottish Enlightenment open the volume. Roger Emerson identifies “Scottish contexts for David Hume’s political-economic [End Page 123] thinking” (10), and Ian Simpson Ross traces “the emergence of David Hume as a political economist” (31) in a more strictly biographical perspective. Emerson draws on his knowledge of Scottish improvers, most notably Lord Ilay, third duke of Argyll, and explores the several ways in which Hume could have been aware of their activities and the issues they had to confront. Ross directs attention to specific episodes in Hume’s life that may have stimulated Hume’s interest in economic affairs. By their use of the conditional and the subjunctive, both contributors acknowledge that the suggested connections are speculative: for reasons which he left to be inferred, Hume was reluctant to apply his arguments explicitly to local, Scottish circumstances. But as Ross demonstrates in the case of Hume’s friendship with Isaac Pinto, and later in the volume Robert Dimand documents in the matter of Hume’s memorandum on Canadian paper money, there are still details of Hume’s biography to be filled out. As more Hume letters become available, it is likely that further such episodes may come to light: Hume’s biography is not an exhausted subject.A fine essay by Christopher Berry on “Hume and Superfluous Value” (49) opens the second set of contributions. Re-visiting Hume’s intervention in the Luxury Debate, Berry argues that Hume rejected the Stoic ideal of poverty embodied in Epictetus’s view that slippers were simply for the protection of the foot indoors, and any ornamentation was superfluous “luxury.” Instead, Hume deliberately attached value to the superfluous. It was precisely the indulgence of luxury, the enjoyment of a more beautiful slipper, which aroused and sustained the “industry” of men, whence derived the enrichment of society and the strengthening of the power of the sovereign. Other contributions in this group are less successful. Till Grüne-Yanoff and Edward McClennen target Albert Hirschman’s thesis that in a commercial society the passions are tamed by the increasing importance attached to the particular passion of “interest.” Instead of relying solely on “interest,” Hume envisages an evolution or “refinement” of the passions, in which reason “serves” the passions by helping individuals to determine how to achieve their ends (86). Quite why this process should be termed a “natural history of the passions” (86) is, however, unclear, as is the extent to which the authors wish to rehabilitate “reason” in Hume’s explanation of action. Richard Boyd seeks to extrapolate from Hume’s writings a concept of “civility” adequate to the pluralism of modern commercial society. Recent EEG studies on the early postmortem interval that suggest the persistence of electrophysiological coherence and connectivity in the brain of animals and humans reinforce the need for further investigation of the relationship between the brain’s activity and the dying process. Neuroscience is now in a position to empirically evaluate the extended process of dying and, more specifically, to investigate the possibility of brain activity following the cessation of cardiac and respiratory function. Under the direction of the Center for Healthy (...) Minds at the University of Wisconsin-Madison, research was conducted in India on a postmortem meditative state cultivated by some Tibetan Buddhist practitioners in which decomposition is putatively delayed. For all healthy baseline and postmortem subjects presented here, we collected resting state electroencephalographic data, mismatch negativity, and auditory brainstem response. In this study, we present HB data to demonstrate the feasibility of a sparse electrode EEG configuration to capture well-defined ERP waveforms from living subjects under very challenging field conditions. While living subjects displayed well-defined MMN and ABR responses, no recognizable EEG waveforms were discernable in any of the tukdam cases. (shrink)

The Framers understood the Constitution to be the fundamental expression of the rule of law over against the arbitrary, intemperate, and unjust “rule of men” that all too frequently existed in the political world, unfortunately both democratic as well as monarchical. Accordingly, the rule of law requires a well functioning political and legal system that includes legislative checks and balances, the separation of power between the President and Congress, an independent judiciary, federalism, etc. What happens when this “Madisonian” constitutional system, (...) designed to express “the deliberate sense of the community,” runs into a Judicial branch that, in effect, claims we live under a Constitution, but the Constitution is what we say it is. This commentary reflects upon an interview with Roland Barthes from 1965 in which he discusses the structural analysis of narrative. The presentation prefigures the publication of Barthes’ well-known essay, ‘ Introduction à l’analyse structurale des récits’, which appeared shortly after in Communications, No. 8, in 1966. A close reading of both interview and essay shows that the interview differs from the published essay, notably in following more explicitly the steps of Saussure’s attempts to work out the units of the linguistic (...) system, using a criterion called commutation. Consideration is also given to the next phase of Barthes’ work on narrative in S/Z (published in 1970), raising the question of what might have transpired had Barthes chosen to remain with an exploration of the actantial and narrational levels identified in his early interview. In bioethics, discussions of justice have tended to focus on questions of fairness in access to health care: is there a right to medical treatment, and how should priorities be set when medical resources are scarce. But health care is only one of many factors that determine the extent to which people live healthy lives, and fairness is not the only consideration in determining whether a health policy is just.
